Shorts Music Pro - Terms of Service

1. Acceptance of Terms

Welcome to Shorts Music Pro! By submitting an application to work with Shorts Music Pro, accessing our website, platform, music library, or any other services (collectively, the "Services") offered by Shorts Music Pro ("SMP," "we," "us," or "our"), you ("you," "your," "User," or "Creator") agree to be bound by these Terms of Service ("TOS" or "Agreement"). Acceptance of these Terms occurs the moment you submit an application to SMP, regardless of whether your application is ultimately accepted or rejected. If you do not agree to these Terms, you may not apply for, access, or use the Services.

You represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. You also represent that any information you provide to us is true, complete, and accurate. You agree to update such information to keep it accurate for the duration of this agreement.


2. Description of Services

Shorts Music Pro is a curated platform providing a library of high-quality, copyright-safe music ("Music") for use in YouTube Shorts videos. SMP also offers a revenue-sharing program for eligible creators, along with resources and tools to help creators grow their YouTube channels.

  • Copyright-Safe Music: "Copyright-safe music" refers to music tracks owned or licensed by Shorts Music Pro that are cleared for use on specified platforms in compliance with YouTube's Content ID policies, SMP's Content Guidelines, and these Terms.

  • Platform Focus: While SMP is currently focused on YouTube Shorts, the Services may expand to include other short-form video platforms in the future. If such expansions occur, SMP will notify users and update these Terms accordingly.


3. Application and Eligibility

Shorts Music Pro is an exclusive program for creators who apply and meet our eligibility criteria. We evaluate applications based on factors such as content quality, audience engagement, consistency of uploads, and adherence to YouTube's Community Guidelines.

  • Application Process: Submit an accurate application through our website.

  • Selection Criteria: Applications are evaluated based on criteria like content quality and audience engagement.

  • Acceptance/Rejection: Accepted applicants will receive a notification with further instructions. SMP reserves the right to reject any application for any reason.


4. Account Creation

Upon acceptance into the Shorts Music Pro program, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials.

  • Security Disclaimer: You are solely responsible for maintaining the security of your account credentials. SMP is not liable for unauthorized access resulting from your failure to secure your credentials. Notify SMP immediately of any unauthorized use or breach of security.


5. Music License and Usage

  • License Grant: SMP grants you a non-exclusive, non-transferable, non-sublicensable, limited license to use the Music from our library solely in your YouTube Shorts or approved platforms, subject to these Terms.


  • License Term: The license remains active only while your account is in good standing. Upon termination, all rights to use SMP Music are revoked, and you must remove any content containing SMP Music unless otherwise agreed in writing.


  • Prohibited Uses: You may not:


    1. Distribute, sell, sublicense, or transfer the Music to third parties except as incorporated into YouTube Shorts.

    2. Modify the Music beyond basic editing (e.g., trimming, looping).

    3. Use the Music in content that promotes hate speech, violence, or defamation, violates third-party rights, or breaches any applicable laws.

    4. Use the Music on unapproved platforms.

  • Attribution Requirements: Provide appropriate attribution as specified by SMP guidelines.


  • Content ID Claims: SMP uses YouTube's Content ID system to manage and track the use of its Music. Your Shorts containing our Music will receive Content ID claims from SMP, which you agree not to dispute.



6. Revenue Sharing Program

  • Eligibility: Available to creators who meet criteria such as consistent creation of high-quality content using SMP Music and audience engagement.


  • Payment Terms:

    • Payments are made monthly but subject to a two-month delay due to YouTube's reporting timelines. For example, earnings accrued in January will be paid at the end of March.

    • Earnings are payable only when they exceed a threshold of fifty (50) USD.

  • Termination and Earnings:

    • If terminated for breaching these Terms, unpaid earnings are forfeited.

    • If terminated amicably, unpaid earnings will be paid according to the standard payment schedule.


7. Content Guidelines

You agree that your Shorts using SMP Music will not contain:

  1. Inappropriate Content: Content promoting violence, hate, or defamation.

  2. Low-Quality Content: Spammy or algorithm-manipulating content.

  3. Illegal Content: Content violating applicable laws.

  • Enforcement: SMP enforces these guidelines through manual and automated reviews. Violations may result in account suspension or termination.


8. Intellectual Property

  • SMP Ownership: SMP retains ownership of the Music Library and associated intellectual property rights.

  • User Content License: By using SMP Music, you grant SMP a non-exclusive, worldwide license to use your Shorts for marketing and promotional purposes.

  • DMCA Compliance: Report copyright infringements to contact@shortsmusicpro.com with necessary details (e.g., description, location, contact information).


9. Disclaimers and Limitations of Liability

  • Disclaimer of Warranties: The Services are provided "as is" without warranties of any kind.

  • Limitation of Liability: SMP’s total liability to you for any and all claims arising out of or related to this Agreement or your use of the Services shall not exceed the amount of fifty (50) U.S. Dollars (USD) or the amount you have paid to SMP, if any, in the past twelve (12) months. For the avoidance of doubt, this clause does not imply any upfront costs or fees for using the basic Shorts Music Pro service, which is free. This clause addresses potential liability in the case of legal disputes.

10. Indemnification

You agree to indemnify and hold SMP harmless from claims, liabilities, damages, or losses arising from your use of the Services or your violation of these Terms.


11. Termination

  • Warnings: Users who violate these Terms will receive a warning and an opportunity to rectify the issue.

  • Final Termination: Repeated violations will result in termination without further notice or reimbursement of unpaid earnings.


12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ireland. Disputes shall be resolved exclusively in Irish courts. You agree to resolve disputes individually, waiving your right to participate in class actions.


13. Changes to Terms

SMP may modify these Terms with prior notice. Continued use of the Services constitutes acceptance of revised Terms.


14. Entire Agreement

These Terms constitute the entire agreement between you and SMP.


15. Severability

If any provision is held invalid, the remaining provisions remain enforceable.
